What specifically do I need to inform employees of when TUPE is taking place?
Employers need to notify the employees that the transfer is taking place and the detail involved needs to include the following:
- When it is happening (this can be approximate if you don’t know the exact date)
- The reason for the transfer
- Any legal, social and economic implications that will affect employees
- What measures will be taken, or you envisage happening
If the business is relocating, can employees be dismissed?
This may constitute as an economic, technical or organisational (ETO) reason. Therefore this may mean that, in this situation, a TUPE transfer is a justifiable reason for dismissal. As always, the dismissal(s) must be handled in a fair and reasonable way that follows the organisations and the legal process.
